Florida HOA Intent-to-Lien Notice Mailing Requirements
Before recording a lien for unpaid assessments, a Florida homeowners’ association must send the statutory demand by registered or certified mail with return receipt requested and by first-class mail, giving the owner 45 days to pay.
Trigger
An HOA intends to record a claim of lien for past-due assessments or other covered amounts.
Sender
The homeowners’ association or its authorized manager or counsel
Recipient
The parcel owner at the addresses specified in § 720.3085(4)(b)
Timing
The owner receives a 45-day payment period before the association records the lien.
Mailing method
Registered or Certified Mail, return receipt requested, and first-class U.S. mail to the required address or addresses.
Jurisdiction
Florida; verified 2026-08-01
- Use the substantially prescribed Notice of Intent to Record a Claim of Lien.
- Itemize assessments, late fees, interest, certified-mail charges, and other allowed costs.
- Identify the parcel and association and provide payment instructions.
- Export delinquent owner and parcel addresses from the association system.
- Coordinate the certified-return-receipt and first-class copies as two required production steps.
- Retain the notice, both mailing records, receipt, and payment-deadline status per parcel.
Where KiteCourier fits
Excellent recurring portfolio fit for association managers and counsel, especially for CSV preparation and per-owner evidence records.
Product constraint
KiteCourier’s standard send does not currently guarantee the separate first-class copy. The association must complete and document that additional mailing.
Alternatives
- Registered Mail may replace Certified Mail for the trackable copy.
Exceptions and qualifications
- An address outside the United States changes the first-class-mail sufficiency rule.
- A later intent-to-foreclose notice is a separate workflow with its own 45-day period.
