Florida Repossessed-Vehicle Subsequent-Lienholder Notice Requirements
Before selling a repossessed Florida vehicle, the repossessing lienholder must send notice by certified mail to each subsequent lienholder named on the last-issued title.
Trigger
A lienholder repossesses a vehicle and plans to sell it while a subsequent lien appears on the title.
Sender
The repossessing lienholder
Recipient
Each subsequent lienholder named on the last-issued certificate of title
Timing
At least five days before selling the repossessed vehicle.
Mailing method
Certified Mail using the form prescribed by the department.
Jurisdiction
Florida; verified 2026-10-28
Timing
When the notice has to go out
At least five days before selling the repossessed vehicle.
The notice must be sent at least 5 days before the vehicle is sold.
This counts calendar days from the date you enter. Florida Statutes § 319.28(2)(b) says which date the count starts from, whether mailing or delivery counts, and what happens when the last day falls on a weekend or holiday. If your rule counts from delivery, allow for transit: most letters arrive about 6 business days after they are sent, and about 4 in 5 within 10.
- Use the department-prescribed repossession notice form.
- Identify the repossessed vehicle and proposed disposition.
- Preserve proof of the required notice for the title application.
- Review the last-issued title for every subsequent lienholder.
- Mail early enough to protect the sale date and protest period.
- Attach proof of notice to the repossession or title application file.
Where KiteCourier fits
Good evidence fit for lenders and repossession agencies, but the triggering recipient condition makes volume comparatively narrow.
Product constraint
KiteCourier does not provide the department form, title search, or protest monitoring.
Exceptions and qualifications
- The workflow applies only when a subsequent lienholder is named on the last-issued title.
- A sworn written protest filed within 15 days after the notice was mailed keeps the department from issuing the certificate of title for 10 more days.
